Terms of Service

1. Acceptance of Terms

By accessing or using the OmniFix platform and associated services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

OmniFix is a cloud-based property maintenance management platform that enables property managers, administrators, contractors, and tenants to manage, track, and resolve maintenance requests. Features include request management, contractor assignment, PDF report generation, and billing management.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You must be at least 18 years old to create an account.
  • One account may represent one organisation (tenant). Sharing accounts across organisations is prohibited.

4. Subscription and Billing

OmniFix operates on a subscription model. Billing is based on the number of active seats (administrator users) within your account.

  • Subscriptions are billed monthly or annually, as selected at sign-up.
  • The first seat is included at no charge on eligible plans.
  • Payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service.
  • We reserve the right to change pricing with 30 days' written notice.
  • Refunds are issued at our discretion. Requests must be submitted within 14 days of charge.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws.
  • Attempt to gain unauthorised access to any part of the platform or related systems.
  • Upload malicious code, viruses, or disruptive content.
  • Scrape, crawl, or systematically extract data from the platform without written consent.
  • Impersonate another person or entity.
  • Interfere with the integrity or performance of the Services.

We reserve the right to suspend or terminate accounts that violate these policies without prior notice.

6. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described therein.

You retain ownership of all data you input into OmniFix. You grant us a limited, non-exclusive licence to process and store that data solely to provide the Services.

7. Intellectual Property

All intellectual property in the OmniFix platform — including software, design, logos, and documentation — is owned by OmniFix Pty Ltd or its licensors. These Terms do not grant you any ownership rights in the platform.

You may not copy, modify, distribute, sell, or sublicense any part of the Services without our prior written consent.

8. Availability and Modifications

We aim to maintain 99.5% monthly uptime for the platform. However, we do not guarantee uninterrupted availability and may perform scheduled maintenance with advance notice.

We reserve the right to modify, suspend, or discontinue any feature of the Services at any time. We will provide reasonable notice where practical.

9. Limitation of Liability

To the maximum extent permitted by Australian law, OmniFix Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Services.

Our total liability to you for any claim arising from these Terms or the Services shall not exceed the total fees paid by you in the three months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless OmniFix Pty Ltd and its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the Services or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of South Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Australia.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the platform. Continued use of the Services after changes constitutes your acceptance of the revised Terms.
